Florida homeowners’ associations may see additional costs if two bills filed this week in the state legislature are approved.
State Sen. Ileana Garcia (R-Miami) filed Senate Bill 906 on Monday, which would create a new state agency called the Office of the HOA Ombudsman. The office would help community association members understand their rights and responsibilities, and monitor disputes involving HOA meetings and elections.
The legislation also expands oversight powers for the Division of Florida Condominiums, Timeshares and Mobile Homes to monitor HOA activities and enforce state regulations.
A companion bill, Senate Bill 908, would require HOAs with more than two parcels to pay the division an annual fee of $4 per residential parcel. HOAs failing to pay by March 1 would face a 10% penalty on the amount due. According to the bill, delinquent associations would lose standing to file or defend lawsuits in Florida courts until they pay the HOA fees and penalties.
Both bills would take effect July 1, 2026, if passed during next year’s legislative session.
